Regulatory
Changes Related to Commencement Level Mathematics Requirements
Approved at
its May 22-23, 2006 meeting, the Board of Regents approved changes
to section 100.5 (a)(3)(iv), 100.5 (a)(5)(b)(2), 100.5 (b)(iv)(c),
100.5 (b)(v)(a), and 100.5 (b)(x) of the Regulations of the
Commissioner of Education. The action clarifies policy changes for
commencement level mathematics, including graduation requirements,
units of credit, and types of diplomas, during and after the
transition from Regents Examinations in Mathematics A and
Mathematics B to Regents Examinations in Integrated Algebra,
Geometry, and Algebra 2 and Trigonometry. These changes are
effective June 15, 2006 and will primarily affect students who first
enter grade 9 in September of 2008.

2006-07. The ProFileTM website is now available to help teachers manage

Student Statewide Assessment Policy Update:
Commissioner Mills has issued a field memorandum regarding the Regents
and Department's efforts to advocate for change in the federal policy
that requires all English language learners (ELLs) who have been in this
country for more than one year to take their state’s English language
arts tests. Even as the Department works to change the U.S. Department
of Education's policy, we must follow the law and implement the policy
during this coming year. The field memorandum, which is available at

number of additional steps the Department has undertaken at various
levels to help our ELL students.

Administration Manual - The
Administration Manual offers an in-depth discussion of the requirements
for the 2006-07 NYSAA. The Manual includes the forms that are required
for this year as well as resources to assist teachers in administering

A new field memo is
being issued, describing
Important Changes Regarding Administration of the
New York State Alternate Assessment (NYSAA) for 2006-07.
To implement federal requirements regarding
alternate assessment of students with severe cognitive disabilities,
schools must modify their administration of NYSAA for 2006-07 as
described in the field memo.

Student Statewide Assessment Policy/Title I Requirements:
In response to the U.S. Department of Education's recent findings that
the New York State English as a Second Language Achievement Test can no
longer be used for Title I accountability purposes, the Department has
changed its policy on the assessment of LEP/ELL students beginning with
the 2006-07 school year.

11/1/05- Appeal to Graduate with a Lower
Score on a Regents Examination, 2005-2006: Beginning with students
entering grade 9 in 2005, students who have a 65 course average but whose
highest score on the course's Regents examination is below but within 3
points of 65 score may appeal to graduate with a local or Regents diploma
using this lower score. Appeals forms and guidance regarding the appeals
