For School Districts Interested in Beginning Implementation in September 2005
The Board of Regents, at its May 2005 meeting, adopted amendments to Sections 100.3 and 100.4 of the Commissioner’s Regulations. The amendments implement the three-model middle-level strategy to implement the Regents Policy Statement on Middle-level Education adopted by the Regents in February. The three-model strategy provides a continuum of options based upon the need and capacity of a district and a school to adapt its curriculum and instructional practices.
Model A (Comply with Existing Regulations): Districts and schools with middle-level grades (grades 5, 6, 7, 8) continue to comply with the current regulations, making full use of the existing flexibility provisions.
Model B (Strengthen the Academic Core): Districts, on behalf of their schools with middle-level grades, propose a program that strengthens the academic core, provides effective academic intervention services, and ensures that all students receive instruction in those standards areas where there are no required State assessments.
Model C (Build on Success: Develop Next Generation Schools and Programs): Districts, on behalf of their schools with middle-level grades, propose either new ideas for restructuring the full educational program (Model C-1) or specific program refinements or enhancements in an area where there are no required State assessments (Model C-2).
Model A: All schools with middle grades are eligible for Model A. No application is required.
Model B: Schools that are either newly formed or that have been identified as a school requiring academic progress (SRAP) in year 3, 4, or 5, including a school identified for school improvement for three or more consecutive years under 20 U.S.C. section 6316(b), or a school under registration review (SURR) pursuant to section 100.2(p) of Commissioner’s Regulations are eligible to submit a Model B application.
Model C: Schools that are either newly formed or that do NOT meet the Model B criteria are eligible to submit a Model C-1 or C-2 application.
Model B, C-1 and C-2 applications must not conflict with the collective bargaining agreements.
The application materials (both forms and rubrics) are being posted initially in draft form. This allows the Department to solicit, for a one-week period (June 1-8, 2005), public comment on both the application forms and the rating rubrics while also providing districts interested in submitting a proposal to begin implementation in September 2005 with the basic information and guidance they need to begin developing an application. Comments and reactions to the draft materials should be submitted by June 8, 2005, to nclbnys@mail.nysed.gov.

Revised application materials for proposals that would begin implementation in September 2006 will be posted in late June 2005.
Districts proposing to begin implementing a Model B, C-1 or
C-2 proposal in September 2005 are requested to mail one (1) signed original,
five (5) paper copies, and one (1) electronic copy (disk or CD) of the completed
application postmarked by Friday, July 1, 2005
