NCLB Title V, Part A - Innovative Programs
Requirements for maintenance/control of materials and equipment provided to non-public schools
Title V-A provides no funds to LEAs beyond August 2009, however, the Title V-A program statute and the Education Department General Administrative Regulations (EDGAR) still require that LEAs maintain title to, and administrative control over, and materials and equipment acquired with program funds for the purpose of providing Title V-A services to non-public school students. Two options have been identified that LEAs may utilize concerning these items now that Title V-A is no longer funded."
2008-09 NCLB Consolidated Application
- There is no FY 2008 funding appropriation for Title V, Part A – Innovative Programs. Local educational agencies (LEAs) may still use transferability to apply 2008-09 funds from other eligible NCLB titles for the purposes of Title V; and may use Title V carryover funds remaining from the 2007-08 school year.
Note that any use of carryover funds or transferability must meet federal private school participation requirements
– see, in particular, item F-9, page 12.
- If an LEA intends to use either or both of carryover or transferability in 2008-09, it must complete the appropriate sections of the 2008-09 NCLB Consolidated Application.

Allowable uses of funds
NCLB Title V, Part A funds are one of the most flexible sources of LEAs’ NCLB allocational funding. Allowable uses of the funds include teacher, student, library and health purposes. All uses are intended to support the Title’s broad purposes to:
- support local education reform efforts consistent with statewide reform efforts
- implement promising educational reform programs and school improvement programs based on scientifically based research
- innovate for educational improvement, including support programs to provide library services and instructional and media materials
- meet the educational needs of all students, including at-risk youth
- develop and implement education programs to improve school, student, and teacher performance, including professional development activities and class size reduction programs
Annual LEA reporting
Each year the U.S. Department of Education (USDOE) requires that States report on the extent to which LEAs have used Title V funds to support USDOE’s four Strategic Priorities for the program. These priorities (see 2007-08 form
(148KB)) are not direct restatements of allowable uses. Districts will need to determine which of their allowed uses of 2007-08 funds supported these priorities, and must report this information to NYSED, usually in January-February. District superintendents will be notified when the on-line submission form becomes available.
Since the Spring 2009 federal report will collect data from the 2007-08 school year, we anticipate that the reporting requirement will remain even though Title V is not funded in 2008-09.
