Appeals Involving Homeless Children or Youth

The Regulations on the 310 appeal process concerning a homeless child or youth and the forms used to file the appeal may be obtained from the New York State Education Department's Office of Counsel.

File an Appeal to the Commissioner Involving Homeless Children or Youth

School districts are obligated to have procedures in place for the prompt resolution of disputes regarding school selection, enrollment, and/or transportation of a homeless child or unaccompanied youth.  These procedures are listed below in the guidance memo concerning the 310 appeal process.  A Question & Answers concerning the 310 appeal process is also available below.
