Proposed Commissioner's Regulations, Part
100.2(p)
Proposed Amendment of section 100.2(p) of the Regulations of the Commissioner of
Education, relating to school and school district accountability
The following
proposed amendment will
conform the Commissioner’s Regulations with New York State's
approved accountability workbook pursuant to the No Child Left Behind Act of
2001 (NCLB), Public Law 107-110, particularly in terms of revising the school
and school district accountability plan to incorporate the results from New
York’s new grades 3-8 testing program in English language arts and mathematics.
The regulations have also been amended to incorporate select flexibility that
has been made available by the United States Department of Education to New York
in the mostly recently approved NCLB workbook.
A Notice of Emergency Adoption and Proposed Rule Making will
be published in the State Register on October 4, 2006.
The proposed amendment will become effective September 19, 2006.
Confirmation of the emergency measure as a permanent rule will be submitted to
the Board of Regents for action at the December 4-5, 2006 meeting.
Any comments regarding the proposed amendment may
be submitted to Jean Stevens, Deputy Commissioner for Elementary, Middle and
Secondary and Continuing Education, State Education Department, Room 875
Education Building Annex, Albany, NY 12234.
