Set-Asides for Nonpublic Schools and Special Act School Districts
For Title II, Part A; Title II, Part D; Title IV, Part A; and Title V, Part A

Section 9501(a)(4) of the No Child Left Behind Act requires that, in federal programs other than Title I, Part A, expenditures for eligible nonpublic school children, teachers and other educational personnel be "equal, taking into account the number and educational needs of the children to be served, to the expenditures for participating public school children."

It is the responsibility of school districts to consult with appropriate nonpublic school officials during the design and development of the programs and before any decisions are made that affect the opportunities of eligible children, teachers and other educational personnel to participate in the program. It is also the responsibility of school districts to choose the criteria for determining equitable distribution of the funds and to reach consensus with nonpublic schools regarding the appropriate level of expenditures.

In order to assist school districts in meeting the equal expenditure requirement, the Department computes school district and charter school set-asides for Title II, Part A; Title II, Part D; Title III, Part A; Title IV, Part A; Title V, Part A; and Title IV, Part B using formulas that are in accordance with the NCLB legislation. The set-asides include funds for eligible nonpublic school students, teachers and other educational staff.  These figures are for advisory purposes only, and they are nonbinding. All nonpublic schools and special act school districts known to the Department's Basic Education Data System (BEDS) are included. However, there are a number of nonpublic schools that are not known to the Department, and their exclusion from our list of nonpublic school set-asides does not relieve school districts of their responsibility to consult with those schools and to meet the equal expenditure requirement.

It is also possible that some of the nonpublic schools included in our calculations may not wish to participate in one or more of the federal programs. In that case, it is not necessary for school districts to reserve part of their allocations for those schools.

These set-asides are to be made from the allocations for the applicable school district. The figures presented here do not represent funds in addition to those allocations.

For Title II, Part A only:  Set-asides to nonpublic schools for Title II, Part A are based on the total allocation to the respective school district minus the hold harmless amount for that Title. (The hold harmless requirement provides an LEA with a base Title II, Part A allocation that is equal to what it received in allocations in 2001-02 for the former federal Eisenhower Professional Development and Class Size Reduction programs.)  Set-asides for the other programs are based on the full allocation to the school district.

The nonpublic schools are listed by county and then by school district.  They include school and school district BEDS codes.  Since many nonpublic schools have the same name, be sure to check the BEDS code.
